damaged truck

The delivery of my truck was early, which would normally be good except that I was not there to pick-up or inspect my truck. Sometime in transit the emergency cable was pinched- probably with a tie down. It was narrowed down to a sub-contracted mover. That company denied doing the damage. After fighting with Kim at cascade and her boss about pursuing the other company, i finally paid the towing and repair bill myself. The owner of cascade basicaly said "take me to court, I'm not paying the $ 250. After talking with an attorney, I was told they (Cascade) is ultimatly responsible since I hired them for the move. I filed a complaint with the B.B.B and found out they had other complaints is the past and are no longer a Better Business Bureau company.

Brian, it clearly states in our terms and conditions: Cascade Vehicle Shipping, Inc. will perform due diligence to insure carriers are fully insured. Carriers are responsible for the vehicle while the vehicle is in their possession. Cascade Vehicle Shipping, Inc. is not responsible for any damage done to the vehicle while in the carrier’s possession. There should be an inspection performed by the carrier at both the time of pickup and delivery and a Bill of Lading completed. Shipper (or agent) should inspect the vehicle carefully with the carrier at both the time of pickup and delivery. Shipper (or agent) is responsible for proper preparation of the vehicle for transport. All loose parts, fragile or protruding accessories, low hanging spoilers, fog lights, antennas, etc. must be removed and/or properly secured. Any part that falls off in transit is shipper’s (agents) responsibility, including damages done by said part to any and all vehicles involved. If damage to the vehicle should occur, all money owed for the transport must be paid to the carrier to initiate a claim. Damage must be properly noted on the Bill of Lading and signed by both the carrier and shipper (or agent). Without proper notation of damage on the carrier’s Bill of Lading, shipper (or agent) verifies that the vehicle was received in good condition. Cascade Vehicle Shipping, Inc. must be notified by phone within 24 hours of delivery of the damage. Cascade Vehicle Shipping, Inc. will support shipper (or agent) in filing insurance claims. Claims are to be filed directly with the carrier’s insurance. If the vehicle is valued at a higher than market rate, we suggest you purchase a special insurance rider. You told Cascade that when you left the vehicle, it was in working order,we understand that the vehicle arrived in Washington damaged. We are unclear where the damage occurred whether on the vessel or with the truck. If you can show where the damage occurred, then we will help get you to the proper company, but if we cannot prove where the damage occurred, they we do not know which company to direct you towards.
