On 9/27 we received the email from the customer that the vehicle had damage. We contacted the terminal in the US and ACL(ship line)to get the inspection reports and procedures to file a claim with the carrier. We immediately emailed the claims department to notify them of the issue and forthcoming claim. On 9/28 the terminal directed us to ACL's claim department which we had contacted the day before. On 9/28 we received a reply (included in the emails we have provided)that no claims would be accepted because this was a used vehicle. We additionally have tried to get an inspection report as has the customer from ACL so she can file a claim with her insurance but have received the same response as she has that due to the fact this is a used vehicle no liability is accepted and that they do not know the condition of the vehicle at receipt. On 10/10 and 10/19 the same response was received.
The port of load is used frequently as is ACL and we have never encountered an issue with either. The port of Monfalcone is used mainly when we ship US military personal and again we have not experienced any issues at all with this port. We have always responded in a timely manner and have tried to our best ability to get a resolution the customer will be happy with but however we were unable to as her complaint is witness to.
